A debate on ‘’who is owner of nature’’ between fundamentalist and modern thinker has sailed the developmental model from ‘’to create the wealth of a nation’’ to ‘’new growth diaspora’’. Coordination failure model for development shows that market may fail to achieve coordination among complementary activities. Past decade has witnessed huge coordination failures among the nations (even UN was established to rescue mankind) and resulted in to increased catastrophe and mass destruction ignited by terrorist activities in name of religion, interference of regional mater and ownership over crude oils. Here I will focus myself only to natural gifts that India possess in form of abundant biodiversity, metal sources and coals regions (We can include crude gas sources also).
Now with passage of time, visible scarcity of natural resources for future has generated notions among the environment saviors what are the rights of the human being to access and enjoy with various essential resources given by Nature to all of us. Apart from trust theory, Environmental Human Rights are also protector of citizen to declare that all acts of over accessing the resources for personal use which the earth has provided us at ZERO casts is an act against the society.
There is two class of the people on planet one exploiting resources as their private rights or individual rights over their lands and other engage in protecting the ecosystem. If we go back Justinian was first to announce that everything provided by nature is common to all. In England the King John in 1225 restricted the fishing and other water activities as they were restraining the others to enjoy with natural resources. In India during Maurya dynasty famous Chanakya’ Arth sastha describes that the king should protect different types of forests, water reservoirs and mines by enacting appropriate laws and enforcing them with the assistance of honest and efficient officials. As we know there are three core concepts of Public trust doctrine to save our natural first, certain interests of the citizens are so important that they intrinsic in nature and their free access make them feel a citizen rather than a serf. So to control over such interest cannot be allowed second, some interests are the gift of nature must be reserved for all mankind and third certain use of things is always of public nature so private use is surely an act of misappropriation. It is clear that people’s right are equally important to private property owner’s rights. They are entitled and privileged as citizen to enjoy the same liberty with natural resources as they fell and enjoy with their private rights.
Central flow of natural resources as biggest wealth is a new era challenge, stronger (capitalist) are suppressing the needs and wants of poor countries rich in natural resources. Money and market oriented treatment with these resources has created a rift in society based on ownership and consumer-ship. Today’s development in alternate energy is worth and its technological reach to serve the mankind and environment both is sufficient if given full liberty to merge it with existing fuel practices but giant players of fuel seller and regulators not allowing those fistful significant efforts.
Ownership over electronic goods as gadgets is temporary but ownership over natural resources (metals. Rare earth metals, precious elements) are fundamental in nature. When we take birth really they belong to us as nature has equitably distributed it among all. Make in India call is wise enough to provide millions of jobs to Indians but not at cost of our abundant natural resources but include benefit sharing with community should be priority with government so as not to repeat the history of green revolution a less wisest step to feed millions. India must not be converted to a destination for exploitation of natural resources. Make in India cannot go above Public trust over natural resources depriving our environmental rights to enjoy all what the nature can provide us with zero friction.
